Department of Education
On March 13, 2025, a coalition of 21 attorneys general filed a suit in Massachusetts challenging the Administration's actions to dismantle of the Department of Education, including the Administration's March 11 announcement that the Department would be firing approximately 50 percent of its workforce as part of its goal of a “total shutdown” of the Department. The Department of Education is an executive agency authorized by Congress, with numerous different laws creating its various programs and funding streams. We argue that the Executive Branch does not have the legal authority to unilaterally incapacitate or dismantle the Department without an act of Congress.
